8:30 AM Photo Ricci Case
Dan Biddle, Ph.D., CEO, Biddle Consulting Group, Inc. (BCG)
& Fire & Police Selection, Inc. (FPSI)

Test Validation and the USSC Ricci v. DeStefano Case: How would your department's promotional tests stand up to legal scrutiny? The Court's judgment handed down on June 29, 2009 ruled against the City's decision to throw out the promotional test results because there was not a "strong basis in evidence" that the City would have been successfully sued in a testing lawsuit. Developing a sound and defensible promotional process for fire supervisory positions takes hard work. Legal databases are filled with examples of fire departments that have been challenged for their promotional processes, including several departments that have lost cases much like the Ricci case. What implications does this case have on today's fire departments? Would your department's promotional testing practices stand up to this type of scrutiny? These questions and others will be covered in this session.

3:30 PM Photo Situation Awareness for Managers
Gene Gantt, Chief, Benicia FD (CA)

We all have read and have a good understanding of being aware while on the fire ground or during an incident, but what about our day-to-day activities as managers? This program will focus on our abilities to become aware of the things going on around us both internal and external to our departments. We will discuss situations, news, and your thoughts and ideas on how we handle the "things" presented to us every day. As a Chief Officer, Fire Marshal or a fire service professional, we all have these situations coming at us. Can you be ready to see it happening before it happens? Will you be ready?
